Giuseppa Geremia, procuratore generale aย Genova, durante il processo di appello per evasione fiscale contro Flavio Briatore, ha chiesto una pena di quattro anni di reclusione per l’imprenditore. Una condanna decisamente piรน pesante di quella che il giudice aveva comminato con il primo grado di giudizio: un anno e 11 mesi con la condizionale.
I reati di natura fiscale che vedono coinvolto uno dei piรน noti personaggi dell’imprenditoria e della “vita smeralda” italiana, sonoย legati alla vicenda di noleggio fittizio dello yacht Force Blue, un explorer di 63 metri varato nel 2002 dal cantiere Royal Denshipย comeย come Big Roi ย e ribattezzato dal manager nel 2006 (non a caso le iniziali del suo nome e di quelle della barca coincidono: FB). Lo yacht fu sequestrato dalla Guardia di Finanza nel maggio del 2010 con unโoperazione avvenuta davanti alle coste di La Spezia e che vasto seguito (e polemiche) ebbe sui media dellโepoca. Durante il bliz delle fiamme gialle a bordo erano presenti anche la moglie Elisabetta Gregoraci e il figlio.
โLo yacht ha solo fatto attivitร di noleggio. Non sono un evasore, pensavo di essere in regola. Se la Guardia di Finanza mi avesse detto che dovevo pagare lo avrei fatto senza problemiโ, fu la dichiarazione che Briatore rilasciรฒ nel gennaio 2014 al giudice per le udienze preliminari Nadia Magrini.
Lโimprenditore ed ex manager automobilistico di Cuneo non รจ lโunico personaggio coinvolto nella vicenda. Dopo le requisitorie del procuratore generale Geremia e i pubblici ministeri Patrizia Petruzziello e Walter Cotugno, sono state avanzate anche altre richieste di carcerazione: tre anni e otto mesi per Ferdinando Tarquini, comandante del Force Blue, che dopo la prima parte del processo aveva ricevuto la stessa condanna di Briatore; Pene di poco piรน lievi richieste per gli amministratori della Autumn Sailing Ltd, societร armatrice del 63 metri, che si sono alternati negli anni: due anni e sei mesi perย Dominique Warluzelย (giร condannato in primo grado a un anno e 11 mesi con la condizionale) e due anni per Maria Pia De Fusco, con giร sulle spalle lโobbligo di un pagamento di sette milioni di euro di multa. Il nocciolo della questione ruota intorno allโuso diportistico e non commerciale che avrebbe sarebbe stato fatto da parte di Briatore, ritenuto di fatto il proprietario, nelle acque territoriali italiane dello yacht dal 2006 al 2010.
La simulazione del noleggio, con i relativi vantaggi fiscali, a partire dal ridotto costo del carburante che per le attivitร di noleggio benefica di una riduzione delle accise che abbassa, di fatto, il prezzo dโacquisto al 50% del costo per il normale utilizzatore. Infine, la possibilitร di scaricare i costi che ha una societร rispetto a un privato. Solo per lโIva non versata il conto che lo stato richiede รจ di 3,6 milioni di euro.
In piรน รจ stata anche richiesta dallโaccusa lโaggravante della transnazionalitร del reato, poichรฉ sarebbero stati utilizzati dei collaboratori che lavorano in Paesi esteri. Infine รจ stata anche richiesta la confisca dello yacht. Il processo prosegue il prossimo 30 maggio.
